Overview: 

While spouses hiding assets from divorce court is nothing new, cryptocurrencies are changing the game.  Bitcoin and other cryptocurrencies can be purchased for cash, held electronically without the help of a third party, and transferred nearly anonymously.  This course will provide attorneys with a basic understanding of cryptocurrency and Non-Fungible Tokens (NFTs), how they can be identified, tracked, and valued.  

The course will also discuss basic tax concepts for digital assets and how they impact divorcing spouses that may be splitting crypto assets and the associated tax basis / embedded gain/losses of those assests.

Course Objective: 

  • Understand the types of ways individuals can hold/own cryptocurrency
  • Identify the types of documents and technologies that can provide useful information on digital asset transactions
  • Learn how digital assets can be tracked through subpoenas, and through publicly available “blockchain” data
  • Understand the basic tax regime for digital assets and how it impacts divorcing clients
  • Understand the types of digital assets that exists and how they can be valued
